Most investment professionals take pride in the manner they act on your behalf. But if the professional you entrusted with keeping your funds safe and properly invested has violated your trust and you have incurred meaningful losses then you need to seek experienced, professional assistance to determine whether your financial adviser breached a duty owed to you, and to determine whether you can recover your investment losses.

Many people just like you have no idea they have been defrauded. They are told and believe “that’s just how the market works.” In reality, your broker or advisor may have misled you with false statements or omissions, unauthorized trading, mutual fund fraud, selling away, over–concentration, Ponzi schemes, failure to follow directions or other type of fraud. On our FAQ page, firm founder Bryan T. Forman explains the many different types of stockbroker and securities fraud and discusses the warning signs to be on the lookout for.

Bryan Forman has spent the majority of his early business career in the brokerage industry, serving as Chief Executive Officer and General Counsel for several brokerage firms which he founded. Mr. Forman is a native Texan, was raised in Tyler, Texas and currently makes his home in Austin.  He is a member of the State Bar of Texas. Bryan is a member of the Million Dollar Advocates Forum, 2024 Super Lawyers and the Texas Bar Foundation.

One of the more common types of investment fraud is placing your funds into an “unsuitable” investment.  In other words, you were sold an investment that did not fit your risk tolerance and investment objectives.

When you open an investment account with a brokerage firm or investment advisor there should be an in-depth written analysis made by your investment professional, including factors like your investing experience, risk tolerances and investment objectives. From this analysis, that investment professional will produce suitability standards unique to you and can build a portfolio with diversified investment products that fit your suitability profile. Before any of your funds are invested each investment product should be explained to you including the risk factors unique to each product. You may be asked to allow discretionary authority to the investment professional. If granted by you, that means he or she can make investments without getting your permission on each one before they can buy or sell a security.

The trouble usually originates when the professional recommends an investment that deviates from the suitability standards. In that case, they are responsible for their negligence in failing to recommend an investment that is suitable for you.

They may also omit facts that would be important to you, including the risks of the recommendation, the fact they would receive higher compensation from the proposed investment, or the tax implications of the recommended investment. The reasons often provided to support an unsuitable recommendation are endless, but the fact remains they took too much risk with your money, or failed to tell you the key facts, and they are responsible for any losses incurred.
