The Texas Hill County is a region within the state that encompasses 25 counties, 3 major rivers, over 5 caverns open to the public for walkthroughs and at least 5 lakes which were created during the 1930’s as part of a project to bring sustainable water table for agriculture, hydro-electric power to the area residents and provide countless sources of water related recreation to tens of thousands each year.
Given the explosive growth in population and residential housing prices seen throughout Texas, especially in Travis and Williamson counties in the 2018-2021 period, small towns such as Marble Falls, Horseshoe Bay, Granite Shoals and Kerrville have seen inflows of affluent new residents including ex-Austinites, tech industry leaders who allow employees to work from home and retirees from other regions in Texas. Even the most experienced and successful investors can be deceived by the overpromised and underdelivered results after those investors believed what they were told, placing significant investment dollars only to see nothing in return. But once again there are potential remedies under the Texas Securities Act. The Act establishes that these deals are considered securities and are subject to the same standards of registration, prohibition of fraud, suitability requirements, and fair dealing as any stock or bond registered for sale in Texas.
Sometimes, investors will lose money unnecessarily, not through bad intentions, but negligence. When you create your account, you should stipulate the levels of risk and volatility the advisor must maintain in the account. If you are managing your own funds and you give your broker instructions to buy or sell a security and he or she fails to promptly enter the order or makes an error on the order that costs you money, they have also violated securities regulations. In most states it would be deemed a violation of the broker’s fiduciary duties that exist from the point at which you place the order until the time it is executed correctly.
